기타 국가유공자와 공동으로 취득한 차량 지분을 1년 이내에 이전받는 경우 취득세 추징 대상 여부

Q. 국가유공자와 차량을 공동으로 등록하여 취득세를 감면 받은 후, 1년 이내에 국가유공자 지분을 공동으로 등록한 자가 전부 이전받는 경우 취득세 추징 대상인지 궁금합니다.

A. 국가유공자등 또는 국가유공자등과 공동으로 등록한 사람이 자동차 등록일부터 1년 이내에 사망, 혼인, 해외이민, 운전면허취소, 그 밖에 이와 유사한 부득이한 사유 없이 소유권을 이전하거나 세대를 분가하는 경우에는 감면된 취득세를 추징하는 것이며, 다만, 국가유공자등과 공동 등록할 수 있는 사람의 소유권을 국가유공자등이 이전받은 경우, 국가유공자등과 공동 등록할 수 있는 사람이 그 국가유공자등으로부터 소유권의 일부를 이전받은 경우 또는 공동 등록할 수 있는 사람 간에 등록 전환하는 경우는 제외한다라고 규정되어 있는바(지방세특례제한법 제29조 제4항), 질의의 경우는 추징되지 아니하는 것으로 판단됩니다.
